In a ruling (attached below) that stands to have wide implications, a federal appellate court has ruled against Yosemite National Park officials and their Yosemite Valley plan. Today's decision, say park officials, not only will halt more than $100 million in construction work on the valley floor but could lead to visitation limits in the scenic valley.
There's more than a bit of irony in the 9th U.S. Circuit Court of Appeal's ruling, which centered on whether the park's development plan for the valley would illegally intrude on the wild and scenic Merced River. The Friends of Yosemite Valley long has maintained it would, and in the fall of 2006 convinced a federal judge that Yosemite's approach violated both the Wild and Scenic Rivers Act and the National Environmental Policy Act.
And yet, while the National Park Service long has understood its primary mission to be conserving natural, cultural, and historic resources, the 9th Circuit's ruling had Yosemite officials lamenting that they might have to limit visitation to the Yosemite Valley to protect the resources.
"The implications here for Yosemite and all national parks are huge," park spokesman Scott Gediman said in a story carried by The Associated Press. "Any further restrictions on visitors or further things we need to do because of this could potentially be detrimental to the visitors' experience, and detrimental to running the park."
This topic has been around a long time. It was spawned by the 1997 Merced River floods that scrubbed clean parts of the valley floor in Yosemite and got park officials thinking about a better layout for lodgings, campgrounds, and trails.

A long term solution would be to restore the Hetch Hetchy valley by removing the dam. This would probably take 50+ years to accomplish, but at least there'd be another valley to visit once it's complete.
I've been to Yosemite many times and the crowds in the valley are very bad, plus it is WAY overdeveloped already. National Parks are for THE PEOPLE, not just the rich, so raising fees to the point that the average person cannot afford it is not the answer. What I would like to see in the valley would be the elimination of overnight camping (except possibly by backpackers/rock climbers...and then limit that to one or two nights), eliminate most if not all accommodations and make the others should be allotted on a lottery bases, once again limited to one or two nights. Private cars should not be allowed in the valley (except possibly if you are holding an overnight lottery ticket). Kangaroo (hop on, hop off) type buses (best available technology) would transport people to and from the valley from campgrounds and accommodations outside of the valley, and outside of the park.
The problem with this valley is that it is being loved to death, while the rest of the park is no busier than any other park, less than many. Most visitors consider the valley to BE THE PARK. It has turned into a small city, and that is a shame. They definitely, 100 percent, should NOT do any more construction!!
I would like to see a mandatory park shuttle system like at Denali/Zion implemented in the Valley. This would be very easy to do do, especially since people already bus into the park via YARTS and Amtrak from Merced...make Merced the place for park visitors to park their cars.
There is a blind faith sentiment from many of the public and media to believe the National Park Service when they make eloquent and lofty environmental statements. When such statements come from Yosemite's Park Spokesman, Scott Gediman, the public wants to trust that they mean well that that there is no hidden agenda. Without the Ninth District Court of Appeals to rule in favor of the plaintiffs, of whom the park’s designated Spokesman, Scott Gediman in an article by the Fresno Bee last week maligned the plaintiffs who the court agreeed with as "a few people with narrow views".
Park Spokesman, Scott Gediman’s so-called "few people with narrow views" represent 52 amici signers nationwide, who signing on to the original litigation, which included the respected Counties of Tuolumne and Madera. In addition there is more than 1,100 signatories on the Yosemite Valley Campers Coalition’s e-petition and more than 500 on their written petition in support of the return of campsites removed after the 1997 flood without public input, after congress gave the park service millions of dollars for campsite flood recover.
The court's decision may now encourage the media and public to delve deeper into these Yosemite planning issue stories to sort through deceptive statements from the Yosemite National Park Service's spokespeople.
Isn't it great that there is a justice system where a small grassroots organization like this and other concerned citizens can find justice and hold accountable the National Park Service who panders to large corporations and private interests in their ongoing effort to raise money for the privatization and commercialization of Yosemite and our other National Parks.
As the late and well respected David Brower once said, "Yosemite should be a nature center, not a profit." Mr. Brower was a staunch supporter of Friends of Yosemite Valley and of their efforts to protect the park.
